PA DEP Serves CSX with Notice of Violation of Solid Waste Law

On July 28th, the Pennsylvania Department of Environmental Protection served a Notice of Violation to CSX for creating a public nuisance and for parking their garbage trains for more than 4 hours next to residential neighborhoods. It was determined that CSX is in violation of Act 97-The Solid Waste Management Act - Section 6018.610(4); transporting solid waste as to create a public nuisance.

CSX Makes Pledge on Trash Train

In response to the two Notices of Violation that the PA DEP issued to CSX in July and September for parking trash trains over 4 hours in violation to the State's Solid Waste Management Act, Bill Penamount of CSX sent a letter to the PA DEP dated September 3rd, read it here, saying that CSX would make an effort to not park trash trains along side the Park, according to PA DEP officials. However, he also claimed that the State had no jurisdiction over the company because of federal law that premts state law. DEP's lawyers are looking into that and deliberating whether or not to take enforcement action.  Thus far, DEP has not fined CSX the $2500 per day stipulated by state law for violations.
